Important summary

This website does not sell directly. If you choose to buy Spryte, you leave this site and complete the transaction on itch.io. Under the “Collected by itch.io” payout model, Itch Corp. is the merchant of record and handles payment, applicable transaction taxes, chargebacks, and refund processing. Spryte remains the developer and licensor of the application.

Spryte is currently an early-release product listed as “In development” on itch.io. It is usable software, but it may contain defects and its features, workflows, compatibility, and file formats may change as development continues.

This summary is for convenience. The sections below control. Nothing here excludes a right or remedy that the law does not allow us to exclude.

01

Website terms

These terms apply when you access this website. By using it, you agree to use it lawfully and not to interfere with its security, availability, operation, or the rights of others. If you do not agree, do not use the site.

The website provides general product and documentation information. We try to keep it accurate, but screenshots, demonstrations, availability, specifications, compatibility, prices, and features may change. The description and terms displayed at checkout apply to a purchase. Links to third-party sites are provided for convenience; those sites are governed by their own terms and privacy practices.

Spryte, its logo, website copy, graphics, and original software are protected by intellectual-property laws. Except as expressly allowed by these terms or applicable law, you may not copy, modify, republish, sell, or exploit them. You may link to public pages and make fair use permitted by law.

02

Purchases, delivery, taxes & refunds

Seller and checkout. Spryte is currently offered only through itch.io. When itch.io’s “Collected by itch.io” checkout is used, Itch Corp. is the merchant of record. Your payment, receipt, currency conversion, transaction taxes, download access, and refund request are handled through itch.io and are also subject to the itch.io Terms of Service. We do not receive or store your full payment-card details.

Digital delivery. Spryte is digital software supplied by download through itch.io; no physical goods are shipped. Before purchase, review the current product page for price, included content, supported systems, technical requirements, and any version-specific limitations.

Refunds and cancellation. Request payment refunds through itch.io support. Eligibility and processing are determined by itch.io’s checkout terms and applicable law. If local law gives you a mandatory cancellation, conformity, repair, replacement, price-reduction, or refund right, that right is unaffected. Where the law permits the withdrawal right for immediately supplied digital content to end after download begins with your prior express consent and acknowledgment, the consent presented at checkout will govern.

Consumer support. For a product defect, license issue, or technical support, contact Spryte through the contact method below. For billing, tax invoices, payment, or a refund transaction, contact itch.io first.

03

Spryte software license

Subject to payment (if required) and these terms, Spryte grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the application for your own personal or internal commercial creative work on devices you control, subject to any seat or device limits stated on the itch.io product page at purchase.

You may use, modify, publish, sell, and commercially exploit spritesheets, renders, textures, project files, and other original output you create with Spryte, provided you have the necessary rights to every input and third-party asset used. Spryte claims no ownership of your original output merely because it was created with the application.

You may not resell, rent, sublicense, redistribute, or make the application itself available to another person; bypass access, activation, payment, or security controls; use it to violate law or another person’s rights; or reverse engineer, decompile, or disassemble it except to the extent that applicable law expressly permits those activities despite this restriction.

The application is licensed, not sold. Spryte and its licensors retain all rights in the application, updates, documentation, and included assets that are not expressly granted. Third-party components or assets may carry separate notices or license terms, which control for those components.

We may suspend or terminate this license for a material breach. Where reasonably possible, we will give notice and an opportunity to cure. On termination you must stop using and delete the application, but termination does not take away ownership of output lawfully created before termination. Provisions that by their nature should survive—including ownership, disclaimers, liability limits, and dispute terms—will survive.

04

Built-in animation content

Spryte includes built-in motion content from three sources with different legal treatment: restricted embedded Mixamo motion content, CC0 material distributed by Mesh2Motion, and the CC0 Universal Animation Library by Quaternius. The restrictions that apply to Mixamo content do not apply to the CC0 assets.

Restricted embedded Mixamo motion content

Some built-in motion content used by Spryte originated from Mixamo. Adobe states that Mixamo characters and animations may be used royalty-free in personal, commercial, and non-profit projects. Adobe’s General Terms govern Adobe Content Files and their use in an embedded end use, and the Mixamo Additional Terms also apply. The underlying Mixamo motion content remains subject to those terms, and Spryte does not claim ownership of it.

Spryte uses the Mixamo motion content only as a restricted, internal part of its character-animation and rendering workflow. It is not advertised, sold, sublicensed, or offered as a standalone animation library. The source animation files are not shipped as ordinary visible FBX or GLB files. During production packaging, the motion data is compressed and encrypted into an authenticated internal package; source paths and filenames are removed from the shipped catalog; and requested motion data is decrypted in memory rather than deliberately written back to disk as a reusable asset. These measures are intended to protect the embedded content, but they are not a promise that extraction is impossible.

No license is granted to use the underlying Mixamo motion content independently of Spryte. You may not extract, reconstruct, convert, redistribute, resell, sublicense, or otherwise use that restricted motion data as standalone or reusable animation content. You may use Spryte’s flattened rendered output subject to these terms and the rights applicable to the models, textures, and other material used in that output.

CC0 Mesh2Motion content

Spryte also includes animation assets distributed by Mesh2Motion and documented in its asset repository. Mesh2Motion identifies its distributed 3D models, rigs, and animations as CC0 1.0 Universal material. CC0 permits copying, modification, redistribution, and commercial use without required attribution. Spryte may therefore package the applicable Mesh2Motion material as GLB content. Spryte provides this identification and attribution voluntarily to document provenance.

CC0 Universal Animation Library

Spryte includes material from the Universal Animation Library (“UAL”) by Quaternius. The library’s official distribution page identifies it as CC0 1.0 Universal. CC0 permits copying, modification, redistribution, and commercial use without required attribution. Spryte may therefore package the applicable UAL material as GLB content. Spryte voluntarily credits Quaternius and identifies the source to preserve clear provenance.

Trademarks and independence

Spryte is an independent product and is not authorized, endorsed, or sponsored by Adobe. Adobe and Mixamo are either registered trademarks or trademarks of Adobe in the United States and/or other countries. References to Adobe, Mixamo, Mesh2Motion, Quaternius, and UAL identify the source or compatibility of content and do not imply sponsorship or endorsement. CC0 addresses copyright and related rights covered by the dedication; it does not grant trademark, patent, privacy, publicity, or endorsement rights.

05

Your imported content & rendered output

Spryte lets you import authorized character models and other project inputs, pose and animate characters using its rendering workflow, and export flattened images and spritesheets. Spryte does not provide an FBX, GLB, BVH, skeletal-animation, keyframe, animation-clip, or other reusable motion-data export.

Spryte processes project inputs and creates output locally on your device unless a feature clearly tells you otherwise. As between you and Spryte, you retain your rights in content you supply and in your original rendered output. Spryte claims no ownership merely because you used the application, but it cannot grant you rights that belong to someone else.

You are responsible for having sufficient rights and permissions for every model, rig, texture, trademark, character, and other item you import or use. Your output remains subject to the licenses and other rights applicable to that supplied content, including copyright, trademark, publicity, privacy, and contractual restrictions. You are also responsible for backups and for confirming that exports are suitable before relying on them in production.

06

Early-release software

Spryte is currently an early-release product identified as “In development” on its itch.io product page. The version available at the time of your purchase may be incomplete and may contain bugs, crashes, performance issues, or other defects. Before purchasing, review the product page for the current version, supported operating systems, included features, technical requirements, and known or stated limitations.

During development, we may add, modify, replace, or remove features; change workflows, compatibility, system requirements, or project and export formats; reset non-essential settings; and release updates on an irregular schedule. Unless we expressly commit otherwise, roadmaps, previews, community discussions, and descriptions of planned features are statements of present intent, not promises that a feature or release will be delivered by a particular date or at all.

Your purchase is for the version and included content described as available at checkout, together with any update rights expressly stated there or required by applicable law. Early-release status does not reduce any mandatory right you have to accurate product information, conformity, required updates, repair, replacement, price reduction, cancellation, or a refund. If this section conflicts with an express product commitment made at checkout, that commitment controls for your purchase.

Keep backups of important projects and exported work, and test the application and its output before relying on them in production.

07

Updates, availability & security

We may provide patches, updates, or new versions and may change or discontinue features. We will not remove a paid consumer’s mandatory rights and, where required by law, will provide updates—including security updates—needed to keep the digital product in conformity for the legally required period. You are responsible for installing available updates and maintaining a compatible, reasonably secure system.

We do not promise uninterrupted availability of this informational website or of third-party distribution services. If itch.io becomes unavailable, contact us about reasonable alternative access for a valid license where feasible.

08

Warranties & limitation of liability

Your mandatory rights come first. Nothing in these terms excludes or limits liability for fraud or fraudulent misrepresentation, willful misconduct, death or personal injury caused by negligence, breach of non-waivable consumer guarantees, or any other liability that cannot lawfully be excluded or limited.

To the maximum extent permitted by law, the website and software are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Spryte is a creative tool; results depend on your inputs, configuration, hardware, and artistic decisions. You must test output and maintain backups.

To the maximum extent permitted by law, Spryte will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss; loss of profit, revenue, goodwill, opportunity, or data; business interruption; or the cost of substitute services, arising from or related to the website, application, or output, even if the possibility was known.

To the maximum extent permitted by law, Spryte’s total aggregate liability arising from the application or these terms will not exceed the greater of (a) the amount you paid for Spryte in the twelve months before the event giving rise to the claim or (b) US$50. This cap does not apply where prohibited by law. These limitations apply under every legal theory and allocate risk reflected in the price.

If you use Spryte on behalf of a business, you will indemnify Spryte against third-party claims caused by your unlawful use, your breach of these terms, or material you use without sufficient rights, but only to the extent permitted by law and attributable to your conduct. This indemnity does not apply to consumers acting outside a trade or profession.

09

Privacy notice

Data controller. Spryte’s publisher is the controller for personal data it directly handles through this website or support communications. itch.io is separately responsible for data it collects during account creation, checkout, payment, download, and support under the itch.io Privacy Policy.

This website. This site has no user accounts, contact forms, advertising trackers, analytics scripts, or non-essential cookies. Our hosting and security provider may automatically process ordinary request data such as IP address, user agent, requested URL, timestamp, and security events to deliver and protect the site. We use that data for legitimate interests in security, abuse prevention, troubleshooting, and service delivery, and retain it only as long as reasonably needed for those purposes or required by law.

The desktop application. Spryte is designed to process imported assets and project data locally. Unless an application feature clearly states otherwise, we do not receive your project files or creative output. Operating-system services, update delivery, activation, crash reporting, or linked third-party services—if enabled in the version you use—may process limited technical data under the notice presented with that feature.

Support. If you contact us, we process the identifiers, message content, attachments, and technical details you provide to answer the request, protect our rights, and keep necessary business records. Do not send secrets or unnecessary personal data. We retain support records only as reasonably necessary for those purposes and legal obligations.

Sharing and transfers. We do not sell personal data. Data may be handled by service providers that host or secure the site, distribute the application, or help provide support; by professional advisers; or by authorities and transaction parties when legally required or necessary to protect rights or complete a business reorganization. Providers may operate in other countries, subject to safeguards required by applicable law.

Your rights. Depending on where you live, you may ask to access, correct, delete, restrict, object to, or receive a portable copy of your personal data, withdraw consent where processing relies on consent, and complain to your local data-protection authority. These rights may have legal exceptions. Use the contact method below; we may need to verify your identity.

This site is not directed to children and we do not knowingly collect personal data from children through it. If you believe a child supplied personal data, contact us so we can address it.

10

Changes, governing law & disputes

We may update these terms prospectively for legal, security, operational, or product reasons. The effective date above will change, and material changes will be communicated where law requires. The version accepted at purchase continues to govern that purchase unless a lawful update applies.

These terms are governed by the law of the country in which Spryte’s publisher is established, without regard to conflict-of-law principles. The competent courts there have non-exclusive jurisdiction. If you are a consumer, this choice does not deprive you of mandatory protections or the right to bring a claim in any court available under the law of your habitual residence. Before filing a claim, please contact us and allow 30 days for a good-faith attempt to resolve it; this does not shorten any statutory deadline or prevent urgent relief.

If a provision is unenforceable, it will be narrowed only as much as necessary and the rest will remain effective. A delay in enforcing a right is not a waiver. You may not transfer the software license except where applicable law permits; we may transfer these terms as part of a merger, reorganization, or sale of the product, with required notice and without reducing consumer rights.
